1. General Provisions.
These Purchase and Sale Terms and Conditions (hereinafter referred to as the “Rules”) constitute a legally binding document defining the mutual rights, obligations, and responsibilities of the Buyer (hereinafter referred to as “You”) and the Seller (hereinafter referred to as “We”) when purchasing goods in the online store (hereinafter referred to as the “e-shop”).
2. Conclusion of the Purchase and Sale Agreement.
2.1. The agreement between You and Us shall be deemed concluded from the moment when You, having formed a shopping cart in the e-shop, provided the delivery address, selected the payment method, reviewed these Rules, and clicked the “Order” button.
2.2. The agreement enters into force when We receive Your payment for the goods within 3 (three) business days and remains valid until the full delivery of the goods.
2.3. Each agreement concluded between You and Us is stored in the e-shop.
2.4. An order sent and printed by email constitutes a pro forma invoice on the basis of which payment is made.
3. Your Rights:
3.1. You have the right to purchase goods in the e-shop in accordance with these Rules and the procedures established by the e-shop.
3.2. You have the right to withdraw from the purchase and sale agreement, except in cases where the agreement is concluded for:
3.2.1. participation in games or lotteries;
3.2.2. other cases where withdrawal from the purchase and sale agreement is not permitted under the laws of the Republic of Lithuania.
4. Your Obligations:
4.1. You must pay for the goods within 3 (three) business days from submitting the order and accept the goods unless otherwise agreed.
4.2. If the information provided in Your registration form changes, You must update it without delay.
4.3. By using the e-shop, You agree to these Purchase and Sale Rules and must comply with them.
5. Our Rights:
5.1. If the Buyer attempts to damage the operation or stable functioning of the e-shop, We may, without prior notice, restrict or suspend access to the e-shop or, in exceptional cases, cancel the Buyer’s registration.
5.2. In the event of important circumstances, We may temporarily or permanently suspend the operation of the e-shop without prior notice.
5.3. We may unilaterally amend the provisions of these Rules.
6. Our Obligations:
6.1. To provide all conditions necessary for You to properly use the services of the e-shop.
6.2. To deliver the goods ordered by You to the address specified by You within the agreed delivery period.
6.3. If, due to important circumstances, We are unable to deliver the ordered goods, We undertake to offer an equivalent product. If You refuse the substitute product, We shall refund the amount paid within 72 hours.
7. Delivery of Goods:
7.1. Goods are delivered by Us or by Our authorised representative.
7.2. Upon delivery, You must inspect the condition of the shipment together with Us or Our authorised representative.
7.3. Upon signing the invoice or delivery document, the shipment is deemed to have been handed over.
7.4. If damage to the shipment is noticed, You must refuse acceptance and note this on the delivery document. If the shipment is accepted and signed for without remarks, it is deemed to have been delivered in proper condition.
8. Return of Goods.
8.1. If goods of inadequate quality are sold and the Seller did not inform the Buyer of defects at the time of sale, the Buyer has the right to request, at their discretion:
8.1.1. replacement of the goods with goods of proper quality;
8.1.2. a corresponding reduction in the price;
8.1.3. free removal of defects within a reasonable time;
8.1.4. reimbursement of expenses incurred in removing defects if the Buyer removed them independently or with third-party assistance;
8.1.5. unilateral termination of the agreement and refund of the amount paid.
8.2. If the Buyer is dissatisfied with the shape, size, colour, model, or completeness of the goods, they may exchange the goods within 14 (fourteen) calendar days from delivery.
8.3. The request to exchange goods under Clause 8.2 shall be satisfied if the goods were not custom-made, unused, undamaged, retain their consumer properties and appearance, and the Buyer provides proof of purchase.
8.4. If the Seller does not have suitable goods for replacement, the Buyer may return the goods within 14 calendar days and receive a refund.
8.5. Return shipping costs are borne by You, except where the goods are returned due to poor quality.
8.6. Requests for exchange or refund under Clause 8.2 shall not be satisfied for custom-made or non-stock goods.
9. Liability.
9.1. You are fully responsible for the accuracy of the data provided in the registration form. We shall not be liable for consequences arising from inaccurate data.
9.2. You are responsible for actions performed using the e-shop.
9.3. You are responsible for transferring login credentials to third parties. If third parties use Your credentials, You are liable for their actions.
10. Communication.
10.1. We send all notices to the email address provided in Your registration form.
10.2. You may send all inquiries and notices using the contact details provided in the “Contacts” section of the e-shop.
11. Personal Data Protection.
11.1. All personal data is processed in accordance with the Seller’s Privacy Policy and applicable laws of the Republic of Lithuania, following recommendations of the State Data Protection Inspectorate.
11.2. The Seller does not transfer personal data to third parties, except as required by law or to parties involved in order fulfilment (e.g. courier services).
12. Final Provisions.
12.1. Distribution of any information from the e-shop without the Seller’s written consent is prohibited.
12.2. These Rules shall be governed by the laws of the Republic of Lithuania.
12.3. Any disputes arising from these Rules shall be resolved through negotiations. Failing agreement, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
